1. Acceptance of Terms

By accessing or using OTR ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting.

2. Description of Service

OTR is a location-based social networking application that allows users to:

  • Discover and connect with other users within a certain radius of their location
  • Engage in one-on-one conversations with matched users
  • Exchange text messages, images, and audio content through the App's chat feature

The App uses location data to facilitate connections between users. Location data is only collected and used while the App is actively running, and your precise location is never shared with other users—only an approximation of your location is used for matching purposes.

3. User Accounts and Eligibility

To use OTR, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Provide accurate and complete information when creating an account
  • Maintain the security of your account credentials
  • Be responsible for all activities that occur under your account

4. User Conduct and Prohibited Activities

You agree to use OTR in a lawful and respectful manner. The following activities are strictly prohibited:

  • Abuse and Harassment: Any form of abuse, harassment, bullying, threats, or intimidation directed at other users
  • Illegal Content: Sharing, transmitting, or soliciting content that is illegal, harmful, or violates any applicable laws
  • Inappropriate Content: Posting or sharing sexually explicit material, hate speech, discriminatory content, or content that promotes violence
  • Spam and Scams: Sending unsolicited messages, spam, or engaging in fraudulent activities
  • Impersonation: Impersonating another person, entity, or misrepresenting your identity
  • Privacy Violations: Attempting to obtain or share personal information of other users without consent
  • System Interference: Attempting to hack, disrupt, or interfere with the App's functionality or security

We have a zero-tolerance policy for abuse. Violations of these rules may result in immediate account suspension or termination, and we reserve the right to report illegal activities to law enforcement authorities.

5. Content and Intellectual Property

You retain ownership of the content you create and share through OTR. However, by using the App, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and transmit your content as necessary to provide and improve the service.

You are solely responsible for the content you share. We do not endorse, support, or assume liability for any user-generated content. You represent and warrant that you have all necessary rights to share the content you post and that such content does not infringe upon the rights of others.

6. Location Services

OTR requires access to your device's location services to function. By using the App, you consent to:

  • The collection of your location data while the App is active
  • The use of an approximated version of your location for matching purposes
  • Location data being processed and stored as described in our Privacy Policy

You can disable location services through your device settings, but this will limit or prevent the App's core functionality. Location data is only collected when the App is actively running and is not used for tracking purposes outside of the App.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using OTR, you consent to the collection and use of your information as described in the Privacy Policy.

8. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason we deem necessary to protect the safety and integrity of our community. You may also terminate your account at any time by contacting us or using the account deletion feature in the App.

Upon termination, your right to use the App will immediately cease. We may delete your account information and content, subject to our data retention policies and legal obligations.

9. Disclaimers and Limitation of Liability

OTR is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, secure, or error-free.

You understand that interactions with other users are at your own risk. We are not responsible for the conduct of any user, and you release us from any claims, damages, or losses arising from your interactions with other users.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

10. Indemnification

You agree to indemnify, defend, and hold harmless OTR and its operators from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another user or third party.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OTR regarding your use of the App and supersede all prior agreements and understandings.
